Legal and Safety Considerations
While Razor Point spikes are entirely legal to use in the UK, there are important restrictions and responsibilities to consider:
- Spikes are generally recommended for installation above 2.4 metres (8 feet) to reduce risk to the public. Many sources and products often quote a minimum height of 2 metres or 2.2 metres but 2.4 metres is the safer, more conservative standard often cited to ensure compliance with the Highways Act 1980, particularly for anti-climb devices that could cause injury to passers-by. Installation above 2.4 metres provides better protection against legal liability for injury.
- Warning signage should always be displayed to alert people to the presence of anti climb measures. Prominently displayed warning signs should be spaced no more than 5 metres apart to provide adequate warning that anti climb spikes are in place.
- Property owners have a duty of care, even to trespassers, meaning installations must be reasonable, proportionate, and properly fixed.
- Razor Point should not be used in locations where children or animals might injure themselves on the barrier.
- Razor Point should never be installed in areas where accidental contact is likely, such as low garden walls or near public walkways.
Under Section 164 of the Highways Act 1980, anti-climb barriers (such as spikes, barbed wire, or razor wire) on land adjoining a public highway are illegal if they constitute a nuisance or danger to users. To comply with the law, these toppings must typically be installed at a minimum height of 2.4 meters (approx. 8 feet) from the ground, as noted. This legislation allows local authorities to serve notice requiring the removal of "injurious toppings" (barbed wire, spikes, broken glass) if they are likely to injure people or animals lawfully using the highway.
Even if the installation is above 2.4 meters, the Occupiers` Liability Act 1984 may still hold homeowners or occupiers liable if the barrier causes injury to someone, including trespassers, if proper warnings (e.g. signage) are not present.
It should also be noted that if the installation of anti climb protection extends the height of a boundary wall or fence above a height of 2 metres then planning permission may be required. Checking local authority guidance and using professional installers can help ensure compliance.
