What are my responsibilities for preventing the spread of Legionella?

All employers and health and safety duty holders have a legal obligation to control and prevent legionella growth. Anyone who does not adequately prevent exposure to legionella can be prosecuted under:

 

  • HWSA (the Health and Safety at Work Act), and COSHH (Control of Substances Hazardous to Health)

 

  • Violations can result in prison time, even if no one has been seriously harmed or killed.

 

The Health and Safety Executive (HSE) has published the L8 Approved Code of Practice (ACoP L8) which sets out guidelines for controlling the spread of legionella. There’s no legal obligation to follow this code of practice, but failure to comply may be used in criminal proceedings as proof that you didn’t take adequate precautions against legionella growth.
