Meet the IP Professional: Khushbu Solanki – Innovation and Advocacy in European Patent Law

Khushbu Solanki, a Chartered and European Patent Attorney and Associate at Cleveland Scott York, has forged a remarkable path over the past eight and a half years. With a background in biochemistry and a fascination with how science interacts with the legal world, her journey into intellectual property (IP) law was driven by a unique combination of curiosity and ambition.

 

"I was drawn to the blend of science and law—it’s such an unusual mix," she explains. "When I began studying IP through a postgraduate certificate, I came to understand the commercial value of intellectual property, and how it helps inventors and businesses bring ideas to market. It’s rewarding on a personal level, but it also pushes science and technology forward for the benefit of all."

 

Her day-to-day work involves drafting and prosecuting patent applications in the UK, Europe, and globally, particularly within the life sciences, pharmaceuticals, chemistry and biotech sectors. She also handles opposition proceedings and design matters.

 

Pioneering in the Unified Patent Court (UPC)

One of Khushbu’s proudest professional achievements to date is qualifying as one of the first UK patent attorneys to represent clients before the Unified Patent Court (UPC). After Brexit, many UK attorneys qualified automatically under a “grandfather clause”—Khushbu was not eligible. Instead, she opted to study for the European Patent Litigation Certificate, an intensive programme delivered through the Academy of European Law and a European university.

 

“I was the only one in my firm who had to take the course separately,” she notes. “But it was important for me to be on that list of UPC representatives.”

 

The UPC is a newly established court that hears infringement and validity disputes relating to European and Unitary Patents across 18 participating countries. Previously, such disputes had to be pursued in each country individually, which was time-consuming and costly. The UPC introduces a more efficient system, with one decision applying across all member states.

 

“What's most exciting is that European Patent Attorneys—who historically haven’t been able to act in litigation—can now take part. It’s opened up a whole new world of opportunities for us,” she says.

 

Her training included hands-on experience, such as simulated UPC trials, which helped her develop a deep understanding of the court’s procedures. “It’s given me an advantage, particularly when combined with the litigation experience of the more senior members of my team.”

 

Looking Ahead at Cleveland Scott York

Khushbu notes that as the UPC becomes more established, client behaviour is beginning to shift. “We’re seeing more clients opt in to the Unitary Patent system because of its wider coverage and cost savings. On the other hand, some are still choosing to opt out, often out of caution—because if a patent is revoked by the UPC, it’s revoked in all countries covered. Before, you might only lose protection in one country.”

 

Scientific Roots and a Passion for Innovation

Khushbu’s scientific background gives her a particular interest in the fast-moving developments within the life sciences sector. “While AI is getting a lot of attention, I’m especially excited about regenerative medicine and immunotherapies for cancer. These advances are genuinely transformative for patient care.”

 

She also highlights the importance of increased government investment in research and how the UPC and Unitary Patent systems make patent protection more accessible, especially for smaller companies.

 

Supporting the Next Generation

Having faced her own challenges along the way, Khushbu is committed to helping others. She describes the process of qualifying as a patent attorney—particularly the exams—as one of the toughest parts of her career. “They’re like nothing else. You can fail, and that can be hard to deal with. But you have to keep going.”

 

Now, she supports new trainees with regular tutorials. “It’s my way of giving back. I’ve gained so much from this profession, and I want to help others through those early hurdles.”

 

Her advice to aspiring attorneys is to stay resilient. “Be patient. The exams are tough, but if you stick with it, you’ll get there. And if litigation interests you, the UPC is a brilliant new avenue—it’s one of the only real entry points for many of us.”

 

She also reflects on her own growth. “When I was starting out, I doubted myself. I’d compare my progress to others. I wish I’d enjoyed the process more. But looking back now, I’m proud of how far I’ve come.”

 

A Life Beyond the Office

Outside of work, Khushbu finds balance through creative pursuits and time spent outdoors. She’s recently taken up sewing as a creative outlet and enjoys swimming—either in the sea near Brighton or at her local pool.

At the heart of it all is her love of learning. “I’m always developing—whether that’s legal knowledge or getting involved in internal systems at work. That drive to keep growing is what motivates me.”
